This Committee was formed by the Developer during the Transition Phase to resolve the dispute over Clearing and Maintenance of the common area Tract 'B'. The Property Manager Marie Thibodeaux was appointed as the chairman and only member of this single person committee. Only one meeting took place with the complainaints. The results of the meeting to resolve the dispute were less than successful. The meeting included an agenda to outline the issues to be covered. To view the agenda

PURPOSE:

The purpose of the Grievance Committee is to provide a mechanism for resolving disputes within the Forest Creek Community.

GRIEVANCES:

  • Only specific grievances between owners will be heard by the Committee
  • The Committee urges both parties to resolve the grievance themselves
  • Grievances directed towards maintenance, rules and regulations or Board of Director's decisions shall be forwarded to the Board or Committee involved
  • The Grievance Committee will be involved only at the point where the person bringing the grievance is not satisfied

ORGANIZATION:

  • Committee members shall be appointed by the Board of Directors
  • The Committee may make modifications to their guidelines as necessary with approval from the Board of Directors
  • The Chairman may assign Committee members to grievances as they arise

GUIDELINES FOR RESOLVING A GRIEVANCE:

  • Remain neutral and objective
  • Endeavor to ascertain all pertinent facts
  • Base resolution of grievance with additional City or County ordinances/guidelines/codes if needed along with the Declaration of Covenant, Conditions and Restrictions of Forest Creek

PROCEDURES FOR PROCESSING GRIEVANCES:

  • Meet with the offended party once written documentation is received to gather facts
  • Meet with the alleged offending party to gather facts
  • Meet with both parties in a neutral place
  • Allow each party to represent their case
  • Only facts related to the grievance and substantiated documentation shall be discussed
  • The role of the Committee is to stay neutral and assist with the grievance for final resolution
  • The Committee shall recommend a course of action on resolving the dispute to the Board of Directors within 10 days from the meeting if both parties can not resolve the dispute among themselves.
